
BlockBeats News, December 18th, according to the WSJ report, U.S. President Trump recently met with renowned lawyer Alan Dershowitz at the White House to discuss the possibility of remaining in the White House after the 2028 election and seeking a third presidential term.
Dershowitz previously served as his legal advisor during Trump’s first impeachment. He submitted a draft of his book to Trump titled “Can President Trump Serve a Third Term in the Constitution,” in which he explored potential paths to circumvent the 22nd Amendment of the U.S. Constitution (which clearly states that a president can only be elected for two terms) in a hypothetical scenario. Dershowitz stated that Trump expressed interest in reading the book and asked for his opinion on the legality of a third term.
In an interview, Dershowitz stated that the Constitution is not “entirely clear” on the issue, but he emphasized that it was more of an “academic and intellectual discussion.” He does not believe that Trump will actually continue to govern or run for a third term before 2032.
According to the report, one scenario proposed by Dershowitz is: if the Electoral College fails to reach the required number of votes (270 votes) to elect a president, the final decision would be made by Congress, creating a “selection rather than election” situation, attempting to bypass the limitations of the 22nd Amendment. However, this view has been criticized by several constitutional scholars, with one professor from Hofstra University Law School bluntly calling it “absurd.”
Currently, the probability on the prediction market platform Polymarket shows that the likelihood of Trump becoming the Republican presidential candidate in 2028 is 5%, while the probability of current U.S. Vice President Pence is 52%.
